Welcome to PodSummarize (podsummarize.com). These Terms and Conditions ("Terms", "Terms of Service") constitute a legally binding agreement between you ("you", "your", "User") and PodSummarize ("we", "us", "our", "Company").
By accessing or using PodSummarize, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Service.
Eligibility:
- You must be at least 16 years of age to use the Service.
- You must have the legal capacity to enter into a binding contract.
- You must not be prohibited from using the Service under UK law.
2. Service Description
PodSummarize is an AI-powered podcast transcription and content generation platform that enables users to:

Upload podcast audio files and get AI-powered transcriptions using OpenAI Whisper
✨ AI Content Generation
Generate show notes, timestamps, YouTube descriptions, titles, and social captions
📺 YouTube Processing
Process YouTube video URLs to extract and transcribe audio
📚 Episode Management
Store, organize, and export your processed episodes
Service Availability: The Service is provided on an "as is" and "as available" basis. We aim for 99.9% uptime but do not guarantee uninterrupted access.
3. Subscription Plans and Pricing
PodSummarize offers three subscription tiers. All prices are in British Pounds (GBP) and exclude VAT (20% added at checkout for UK customers).
Free Tier (Starter)
£0.00 / month
- 30 minutes of audio processing per month
- Basic show notes and timestamps
- Episode library access
- No social media posts or YouTube descriptions
* Limited to first 30 Beta sign-ups
Creator Tier
£11.99/month or £9.99/month (annual)
- 600 minutes per month (~10-13 episodes at 45min each)
- All output formats (show notes, timestamps, YouTube descriptions, titles, social captions)
- Email support
- Standard processing speed
✓ Save 20% with annual billing
Studio Tier (Pro)
£44.99/month or £34.99/month (annual)
- 2,000 minutes per month (~40+ episodes at 45min each)
- All Creator features, plus:
- Priority processing (faster queue)
- API access (automation & integrations)
- Dedicated support
✓ Save 22% with annual billing
4. Payment Terms
4.1 Payment Processing
- All payments processed securely through Stripe
- We accept major credit and debit cards (Visa, Mastercard, Amex)
- We do NOT store your card details on our servers
4.2 Refunds and Cancellations
🚫 No Refunds Policy
- ✗ All payments are non-refundable
- ✗ No prorated refunds for partial billing periods
- ✓ You retain access until the end of your current billing period after cancellation
Cancellation Process:
- Navigate to Settings → Billing
- Click "Cancel Subscription"
- Provide feedback (optional)
- Confirm cancellation
What happens after cancellation: Your subscription ends at the end of the current billing period. No immediate loss of access. Your account reverts to the Free Tier.
4.3 VAT and Taxes
- Prices exclude VAT (Value Added Tax)
- UK customers: 20% VAT added at checkout
- You are responsible for any other taxes in your jurisdiction
5. Usage Quotas and Limits
5.1 Monthly Minutes Quota
- Free: 30 minutes/month
- Creator: 600 minutes/month
- Studio: 2,000 minutes/month
⚠️ Important Quota Rules:
- ✓ Minutes counted by audio duration (not processing time)
- ✓ Quota resets at start of each billing period
- ✗ Unused minutes do NOT roll over
- ✗ Deleting episodes does NOT restore quota (prevents abuse)
5.2 File Limits
- Maximum file size: 50MB
- Supported formats: MP3, WAV, M4A
6. AI-Generated Content Disclaimer
⚠️ No Guarantee of Accuracy
AI-generated content is provided "as-is" and may contain errors, inaccuracies, or omissions.
- ✗ Transcriptions may be inaccurate (accents, background noise, technical terms)
- ✗ Show notes and descriptions may not accurately reflect your content
- ✗ AI models can "hallucinate" (generate plausible but incorrect information)
Your Responsibility
You are solely responsible for:
- Reviewing and editing AI-generated content before publication
- Verifying accuracy and appropriateness of AI content
- Ensuring compliance with your brand guidelines and legal requirements
We are NOT liable for errors, omissions, or consequences of publishing unedited AI-generated content.
7. User Responsibilities and Acceptable Use
Copyright and Permissions
You represent and warrant that:
- You own the copyright to all content you upload, OR
- You have obtained all necessary permissions to upload and process the content
You must NOT upload:
- Copyrighted content without permission
- Content that infringes intellectual property rights
- Illegal, harmful, or offensive content
8. YouTube and Third-Party Content
⚠️ YouTube Terms of Service Compliance
When you process YouTube videos, you must comply with YouTube's Terms of Service.
- ✓ Only process videos you have the right to use (your own videos or with permission)
- ✓ Comply with YouTube's policies on downloading
- ✗ We are NOT responsible for your compliance with YouTube's terms

9. Data Deletion and Retention Policy
⏱️ 3-Day Audio Deletion Policy
Audio files are automatically deleted after 3 days (72 hours) from upload. This applies to all subscription tiers and protects your privacy.
Transcripts & Generated Content:
Retained indefinitely until you delete them (via Settings → Delete Episodes or Delete Account)
Account Deletion:
Navigate to Settings → Delete Account to permanently delete all data.
⚠️ Deleting episodes does NOT restore your usage quota (prevents abuse).
10. Disclaimers and Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, PODSUMMARIZE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
We do NOT warrant:
- Uninterrupted, error-free, or secure service
- AI-generated content will be accurate or suitable for your purpose
- Third-party services (OpenAI, Stripe, YouTube) will be available
- The service will meet your specific requirements
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY UK LAW:
We are NOT liable for:
- Indirect, incidental, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Errors or inaccuracies in AI-generated content
- Third-party actions (YouTube, OpenAI, Stripe)
- Unauthorised access due to your negligence
Our total liability is limited to the amount you paid in the 12 months preceding the claim, OR £100, whichever is greater.
Exceptions: This limitation does not apply to death/personal injury caused by our negligence, fraud, or any liability that cannot be excluded under UK law.
12. Governing Law and Dispute Resolution
Governing Law
These Terms are governed by the laws of England and Wales.
Jurisdiction
Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
Informal Resolution
Before legal action, please contact us at support@podsummarize.com to resolve the dispute. We will respond within 30 days.
